I've fixed this in current. With the current sh,

isl:~% sh
$ egreppat="^(` sed -e 's/[.+*()|[]/\\\\&/g' -e 's/,/|/g' </tmp/t1 `) "
$ echo $egreppat
^(rec\.collecting)
$
