The RSA *patent* expired in September 2000, so that non-RSAREF implementations could be distributed within the US. This was the reason behind FreeBSD 4.1.1-RELEASE. (FYI: You can find this information in the release notes. It also turns up if you search for "rsaref" on the FreeBSD Web site.)
