If the problems are purely legal, there is likely a solution -- provided there is a willingness to look for it. Worst case, e.g. if the problem is a fundamental incompatibility with the Foundation's 501c3 status rather than merely a reluctance to undertake the necessary bookkeeping and other administrative tasks, it might be necessary to set up a separate legal entity to undertake those activities. FreeBSD would hardly be the first 501c3 entity to use that approach.
