The Bmake Makefile is covered by > my/FreeBSD copyright, not FSF's. Sorry, you are right about this one. I remember I see some other files which can go into src/usr.bin/cpio instead. The main idea is keep contrib as far compatible with original distribution as possible to minimize upgrade process and move all local files and additions out of contrib. -- Andrey A.
