Anyone can RUN it out of /usr/sbin, just as anyone can RUN ping even though it's in /sbin. It also seems like more of "systems-y" function -- this isn't something that every user is likely to need. I might have put it in /usr/bin with nohup if I were dreaming this up from scratch, but I don't see what is gained by moving it to a different location than BSD/OS went with.
