Since the translation is a derived work from the original text the translation will be covered by the original authors copyright. This means that if you want to publish a translated work you do need the permission of both the original author and the translator. I did actually read the Berne convention and it contains the following about translations: [Article 2] (3) Translations, adaptations, arrangements of music and other alterations of a literary or artistic work shall be protected as original works without prejudice to the copyright in the original work.
