The literal text of Berne is not the governing law in the US, where FreeBSD's servers are located, and I'm fairly certain that the same is true in all Berne signatories. Many countries provide copyright protections above and beyond that required by Berne. The law in the U.S. is that a translation is a derivative work, and creating derivative works is one of the exclusive rights of the copyright holder.
