If you have any proof that they're collecting addresses from redhat-list, it probably qualifies as theft of service and resource abuse, but I'm not a lawyer. However, you can try to have them shut down. The spammer fakes a hostname in *.hotmail.com -> let abuse@hotmail.com know.
