Development on 4.0 did start when 3.X was stable, but that doesn't mean bugs which cause instability under very specific conditions still weren't found. MANY of the things done in 4.0 by Matt, for instance, cannot be merged into RELENG_3 without making huge, sweeping changes. These changes wouldn't have been made in the "stable", non-development branch. They weren't.
