Do you really? I don't see any reason why it is not possible to
win both.

It'd be easy to have a license that says something like the
following: "You may incorporate this code into your own work
without publishing source. However, if you do publish the
source to this or a derivative work, you must do so under 
this license."

That's only one sentence. Of course, I'm sure the language
could be improved, since I just dashed it off....
