Used a source upgrade from FreeBSD 5.3 to RELENG_6. Encountered a number of problems during the upgrade none of which, I think, would have caused the problem.
At the end of the upgrade there were two versions of freebsd-update (one in /usr/sbin and one in /usr/local/sbin) due to the PATH the older one (no version numbers in either one) was loaded first.

Impossible for me to re-create problem. I had not knowingly installed freebsd-update before but it could have been picked up as a dependency from a port under 5.3.
