The license on softupdates was changed recently and you have to remove the symbolic links. Did you cvsup RELENG_3, which means you were cvsup'ing 3.5.1? I'm running 4.1-Stable and there is an entry in /usr/sr/UPDATING about the symbolic links. You might check /usr/src/UPDATING on your system for similar comments around 0622.
