You are falling under the very common misperception about what
"Illegal" means. The whole idea behind intellectual property protections
like copyrights and patents is to give the owner legal standing to sue
those who violate them. It's up to the patent owner to pursue violators
in civil court. For the most part, the only time there are criminal
penalties are involved is in the case of fraud.
