They weren't thinking. That's the problem. Building a working
cross-platform web site requires the abililty to think. About the
level of a bright fourth grader, but it does require that much.

As a final note, if such a site is run by an agency of one of the US
governments, or an organization that receives funding from such, they
are in violation of the ADA. If the government in question is the
feds, they are violating federal policy.

The question of whether or not commercial web sites doing this are
violating the ADA is still open, as it's not yet clear that a web site
qualifies as a public place under the terms of the ADA. However, it
should be noted that AOL chose to provide an accessible site rather
than finish a court fight about it when they were sued by the National
Federation for the Blind.
