I am no lawyer, but it seems to me that fair use applies and (every) former=
=20
user of this work is allowed to (at least) create a derivative work and=20
release it (under own copyright) to the public as the original work is "out=
=20
of print or otherwise unavailable".

Hope somebody with a law course can jump in with some details and deeper=20
understanding.
