After all, these files _are_ encumbered, and in some way more so than GPLed files, which we so love to eschew. I'm not at all thrilled about automatically downloading softupdate files to my CVS repository, either. Finally, putting them into the repository means they're a part of the base system, whether they're in the correct place or not.
