I'm not familiar with apxs, I'm afraid (die-hard old-school Apache
programmer, me) - can you give me an example of what you mean by this?
i.e. how would I test that it works?

Since both Apache-SSL and mod_ssl have to patch Apache, I don't see how
they can possibly not conflict, I'm afraid.

I've fixed this regrettable situation in Apache 2.0, btw.

Its being tested prior to release. I can send you a pre-release version
if you want (for your use only, so I don't have to bump the version
number if I change it before release).
