Found the problem:
if i open a terminal, restart hald and remove and add the
battery-state applet it works.

as workaround wrote a small script that only calls
"sudo /usr/local/etc/rc,d/hald restart" and add
it to the "Startup Programs".

unless i do this the "Device Manager" also is very
uninformative about my battery.
