No, I don't think, licensing is an issue anymore.
At least OpenBSD folks already committed 8.9.1 into their source tree.
Also, I don't think it's a good idea to run 8.9.x with an old configuration
file. Sendmail will give you tonns of warnings about the configuration
level (whatever it is).

I don't think the port is a good idea. I'd rather see it in the
standard source tree (the same is for bind8 && -stable)
