I had this problem also and found two solutions:
- make apache manual (i.e. outside the ports-tree), but still patch
  all the files when needed.
- upgrade to 4.2 (maybe 4.1.1???)

I think it has to do with the fact that "suddenly" OpenSS* became
forbidden and that not everybody was running 4.1.1+ at that moment.
