People who want the source can surely create the directory by themselves, same for /usr/ports. * (bsd.port.mk also refers to * /usr/ports explicitly.) I don't think /usr/ports is necessary for a system to function. The definition in bsd.port.mk is just a default. You can very well have it elsewhere. The same could be said for /usr/local, now that bsd.port.mk creates ${PREFIX} before running mtree on BSD.local.dist.
