I believe you seriously misunderstand the license.  Anyone who holds a
commercial license may produce binaries that may be used in any way
they wish.  Thus if the FreeBSD project used its commercial license
for icc to produce kernel snapshots or ports or whatever, those products
may be redistribued and used by anyone.
