It's because the port patches configure.ac (so the timestamp of configure.ac is newer than configure and it tries to regenerate configure from it). From what I can tell files/patch-configure.ac can safely be removed as configure already has the same logic in it to set LIBC_NAME (the patch found its way upstream [1]).
