Can we assume that this excerpt from ports/LEGAL no longer applies ?

bzip-*                  ports/archivers/bzip    Some algorithms used may
                                                infringe certain US patents.
                                                Opinions differ. Commercial
                                                use could render you liable
                                                to unfriendly legal action.
