Quote from 'The Complete FreeBSD' by Greg Lehey, 2nd edition page 8:

"The suit was settled out of court, and the exact conditions were not all
disclosed. The only one that became public was that BSDI (and, later,
the FreeBSD project) would migrate their source to the newer 4.4BSD BSD
sources, a thing that both groups were preparing to do in any case. FreeBSD
fulfilled this obligation with the release of FreeBSD version 2.0 in late 1994"

So, in short, FreeBSD is based on 4.4BSD. Probably a case of mistaken
identity here. For further information on the developement process of
FreeBSD, see the handbook, chapter 16 :" The cutting Edge: FreeBSD-current
and FreeBSD-stable".
