That way, if the file > exists, it's locked, so drop out. Good point. This was also pointed out to me by Paul Herman (I copied him on this message) a day or so after I posted the original message. Just one thing I'd like to toss out for comments: from what I've seen, pw(8) is frequently run from within non-interactive scripts. Unless I'm reading them wrong, your patches will make pw(8) fail with an error message if the password file is already locked. I wonder if it should instead block and complete after the lock has been released, rather than force script authors to check for that themselves.
