Consider writing your own do-fetch: target, something like this

do-fetch:
.if !exists(${DISTDIR}/${DISTNAME}${EXTRACT_SUFX})
	${SETENV} ${FETCH_ENV} ${FETCH_CMD} -o ruby-cvs.tar.gz http://.../ruby-cvs=
.tar.gz?only_with_tag=3Druby-cvs-0_2&view=3Dtar.tar.gz
.endif
