And there is currently hubbub, so they look pretty smart. There is no statute or general precedent that I am aware of that settles the relationship between domain names and trademarks. If you've got a citation, I'm happy to be wrong. (Note that I know individual cases have been decided, but there hasn't been a Roe v. Wade or Dred Scot type of decision that's made the prevailing legal interpretation clear.) If you don't have a citation, well, you don't have a case. This is a red herring, anyway.
