Maybe i'm being a bit clueless here (hey it's happened more times than 
I can count and i'm a bit tired) but doesn't the:

constitute the way that most of the BSD license works?

I don't think the source of the code really matters as long as it follows
that spirit:

keep my copyright, don't blame me if it goes "boom"

or am i missing something?

it's not phk's "beer-ware license" but i thought it was official enough
and at the same time "open source" even though it has the:

clause..

I'll retract the statement if you disagree as i do value your judgement.
