I don't know what the deal is with FOOTNOTE, but it looks to me like you
don't really need <programlisting></programlisting> in this context. (I
don't know how to express why you don't, unfortunately.)

A <title></title> usually comes at the start of a section (for example,
right after a <sect1>, <sect2>, <sect3>, etc. tag). Are you starting a
new section here?
