And if the ISP's ads say "free software included with each account" then
they certainly appear to be claiming that they are giving out software
that does not require additional payment by the user. In which case the
ISP will get a nice letter asking for money and if they don't pay, they
will be in court paying their lawyers lots of money. 

If anyone is doing this their only hope is to get legit fast and hope that
they haven't been noticed yet.
