 Firewall lkm loading even when firewall is in-kernel has been fixed 
 (rc.network v 1.11, 1997/09/18 22:43:48).
 
 What has not been fixed is that it is possible to load the lkm when the 
 ipfw code has been compiled into the kernel.  I don't know how to fix 
 this - someone who knows how LKMs work should.
