If you do not have that patch, you should try to see if you can reproduce your
issue without TSO enabled, specifically without a TSO packet ever attempted to
be sent (for example by ensuring TSO is disabled for that interface in
/etc/rc.conf).  Without the above patch in place, and TSO enabled, it may be
possible (that is, has not been ruled out) for the state of the virtual device
to become corrupted via the sending of TSO packets, so disabling TSO on the
interface later might not make a difference.
