There are many different tricks with it, like bad autodetection, hangup etc. So i think it's hardware bug. The worst is that i can't reproduce your case. However it should send ARP packet during ifconfig tx0 inet .... As i understood, it doesn't receive any packets before it send something. Rigth? How does the leds look like? And on the hub? So it should not recieve anything after ifconfig tx0 down up either. Can you check this? Maybe ifconfig tx0 media .... (not autoselect) will help? Good luck.
