The code this patch touc= hes is 14 years old so, obviously it is not the cause of the regression. The regression must be elsewhere. But if it resolves the immediate problem it's better than brokenness. As to what upstream patch caused the regression, it is still under investigation. Ideally the problematic upstream commit will need to be found and discussed with the folks at w1.fi. I don't know if this problem only affects FreeBSD or if other BSDs or Linux are also affected by it.
