Well, feel free to bring a lawsuit. In the U.S., the loser
pays court costs, so be sure you can win before you start.
In reality, a great many lawyers have examined "mere agregration"
like this, and decided that it's not a problem, and the license
specifically states that it doesn't apply, in the last paragraph
of section 2 of the license:
In addition, mere aggregation of another work not based
on the Program with the Program (or with a work based
on the Program) on a volume of a storage or distribution
medium does not bring the other work under the scope of
this License.
I think this applies to the BeOS case, as well.
