It may be that the "To update from 3.x to 4.x stable" mechansim (described in /usr/src/UPDATING) would work, though I would think that the failure you note is not intended. You might want to check the -stable archives to see if anyone else has reported something similar -- I don't recall any such reports, but my memory gets a bit hazy from time to time.
