Read /usr/ports/UPDATING and /usr/ports/CHANGES after updating your ports  
tree.
There is the removal of INDEX documented.

About the ruby thing. Try deinstall/reinstall of ruby and portupgrade  
manually and try again. (This is my best guess.)
