Uh, guys? The only thing Doug obtained from the other driver (which
is Broadcom's driver for Linux, incidentally; it's not part of the
Linux kernel proper) is the concept that flipping bit 'foo' is
required to produce result 'bar.' This concept originates from hardware
documentation (the BCM570x or BCM540x manuals) which is not GPLed.
The code Doug wrote to flip the desired bit is his own.

So relax. :)
