Without having read the full standard in its latest incarnation I think that
clause 37 specifically applies to 1 Gbit/s modes.

But I have always wondered why a device that is able to support
auto-negotiation should abstain from sending its mode parameters only because
its operation mode has been manually specified.

The em driver in FreeBSD has been developed and maintained by Intel employees
and I'd assume that they knew the standard (Jack F Vogel, Eric Joyner).

I see that you have an account on the FreeBSD Phabricator server. You may want
to create a review for your patch with a reference to this bug report and add
Eric Joyner as a reviewer ...
