If the latter, try changing the value of TWE_Q_LENGTH in /sys/dev/twe/twereg.h to 100 and see if you can reproduce it. I am worrying about firmware here at the moment; I don't *think* there are any opportunities in the driver to lose a command. If this doesn't yield anything (you could try the above anyway), I'll try to write you some more debugging code to work out what, if anything, is unique about the command(s) that are getting stuck.
