The way I remember it is that in that time on the SSLeay mailing list was announced that SSLeay was to be superceded by OpenSSL. Which was in fact an outgrowth of SSLeay. Legalities did play some role. But wasn't SSLeay non-US, Aussie I recall, therefore not bound by any RSA patents? That was quite some time ago, though.
